Last time when you had such a meeting Lenin had expressed the threat he and other human rights defenders around or associated with PVCHR are facing.

We are thankful to governments of Ireland, Netherlands and Czech Republic for their constant support in cases related to Dr Lenin. The first secretary, political in Netherlands embassy, in particular was constantly in touch with Lenin to understand the development of the case. He also offered to come down to Varanasi to observe the court proceeding, which has not started yet.

These interactions also resulted in organisations like Frontline providing financial support for covering legal cost. UN rappourtuere too took cognigence of the case.

As a result:

·         There is no direct threat to HRDs working with us from the state.

·         But the indirect threat has increased.

·         No more beating of the accused in the custody.

·         Winning over lawyers is the main strategy to manipulate at the pre trial stage.

·         Nexus between perpetrator, lawyers and lower court to favour some elements in lieu of gain.

 

Discussion on the interaction and communication between Human Rights Defenders and EU diplomats in India (11.00 – 12.00)

·         The victims, perpetrator, human rights defenders, state as well as international agencies are living in different time space. What about the HRDs who do not speak English are we listening to them enough, are we talking about them enough?

·         Relation between state and HRDs are changing due to waves of democratization of information demanding more transparency. HRDs also face the challenges of new accountability. Sometimes leading to deficit of legitimacy.

·         The challenge is to how to reach to the HRDs with real time responses while maintaining relation in virtual time. Issues of human rights defenders must be retooled as a part of the strategy not raised as a part of kneejerk reaction.

·         We all know the power of Internet. India has 85 million internet user, certainly large enough than many of the European country, sadly we have not seen EU creating a dedicated section for leveraging on that target group by posting credible and good narratives of Human Rights Defenders. An effort in this direction would bring synchronization between information availability and media space.

India treats herself to two EPR for the 26th anniversary of Bhopal, in spite of a strong opposition from the local populations

Lyon 3/12/2010- On the 26th anniversary of the Bhopal industrial catastrophe[1], Nicolas Sarkozy and his Indian counterpart made public an agreement guaranteeing the purchase of two EPR reactors from the French contractor Areva. The reactors would be built next to the city of Jaitapur, in the Maharashtra state, an earthquake prone zone[2] – level 4/5- which would significantly increase the risk of a new major industrial catastrophe in the country.

The two EPR reactors that are currently being built in France and Finland already suffer from important delays and over-costs. The budget for Flamanville is thus already overspent by, at least, 1,7 billion euros. The Indian Government is taking the wrong path of nuclear power, by investing in a very expensive and dangerous source of energy. Renewables such as wind or solar power are, on the other hand, already available and for the same amount of money invested, enable the creation of 15 times more jobs than nuclear power does[3].

A strong opposition from local populations

Three thousand local inhabitants got voluntarily arrested last November as a protest against this project[4]. The building of the two reactors threatens indeed not only the local fishing economy but also the health and security of the populations. The Indian Government refused on November 29 entry visas to scientists from the International Panel on Fissile Materials who had organized a meeting to discuss the Indian nuclear program[5]; as a reminder, India has yet not signed the Non-Proliferation Treaty.

By imposing itself in spite of the People's will, nuclear power demonstrates once again that it is not compatible with democracy. Whether in India or in France, nuclear power would not exist if the populations were consulted and listened to[6].


Some PR effect around Cancun

It is not pure haphazard if this announcement is made while in Cancun, the United Nations negotiations on climate change are taking place. In order to obtain always more funds to sell reactors to developing countries, the nuclear industry tries to persuade us that nuclear energy is the answer to climate change. Despite Areva's PR attempt, nuclear power is not a solution to CO2 emissions, whereas energy efficiency and renewables are eleven times more effective when it comes to reduce greenhouse gases[7].

The network "Reseau Sortir du Nucléaire" condemns those deals made at the expense of peoples and the environment, and calls upon populations to keep on resisting these destructive nuclear projects.

Earlier this year, you submitted a communication to the U.N. Special Rapporteur on the right to food, Mr Olivier De Schutter, replying to the Call for Cases on Land rights and the Right to Food that he had launched in December 2009.

We would like to sincerely thank you for your submission. The Special Rapporteur presented his report "Access to land and the right to food" last month in New York at the 65th General Assembly. This report is available on the website of the Special Rapporteur in English, French and Spanish, and in the six U.N. languages on the website of the Office of the High Commissioner for Human Rights (report A/65/281).

The report "Access to land and the right to food" shows that up to 30 million hectares of farmland are lost annually due to environmental degradation, conversion to industrial use or urbanization. The resulting pressures on those depending on land for their livelihoods are further exacerbated by the expansion of agrofuels and the speculation on farmland. The report identifies ways to confer legal security of tenure upon farmers, fishers and indigenous people affected by these pressures. It also asks how agrarian reform can be promoted as an alternative to the global enclosure that we are currently witnessing.

Your contribution was vital in enabling Mr De Schutter to depict the global situation of access to land and the right to food. The Special Rapporteur received 117 cases following the public call, which he analysed in a background paper that was made available at the same time than his report. This document also provides an overview of 115 letters of allegations sent to Governments by the Special Rapporteur in the period from 2003 to 2009 concerning rights related to the use of land and the right to food. The letters concerned 89 different cases in 36 countries. The cases reveal some similarities and trends which shed light on how issues of land use affect peoples' enjoyment of their right to food. Almost every case reported instances in which communities or individuals have been evicted or lost access to land or were facing the threat of eviction or of loosing access to land.

Mr De Schutter has also called for new international initiatives on land investments and land tenure to be strongly anchored in the right to food during the 36th session of the Committee on World Food Security, which was held in Rome on 11-15 October, and he publicly welcomed the outcome of this session which encourages the continuation of the work on Voluntary Guidelines for the responsible governance of tenure of land and other natural resources.

Parmarth: a hope for waters' right in Bundelkhand

PARMARTH has been working towards community water source sustainability by ensuring water security with inclusion & gender perspective. In the last one decade it has focused on the poorest & marginalized groups. The organization believes that awareness and community empowerment ultimately demands governance accountability. The organisation’s spread is limited to the Bundelkhand region of Uttar Pradesh and Madhya Pradesh.
Pani Panchayat, with due representation of women and dalit groups is central to the intervention strategy. It has been playing instrumental roles in ensuring drinking water for the community members through community’s own management. Training of women members and community cadre about maintenance of the hand pumps has helped in ensuring the regular water availability and reducing the drudgery work time (fetching of water) for women & adolescents members in the families. It has also resulted in number of drinking water sources being established & repaired.
The organization has adopted the potential of water-livelihood linkages as a focal long term Integrated Water Resource Management programme in its operational areas. It has also developed model Roof Water Harvesting and soak pits with participatory approach & community contribution strategy for water conservation and protection. Work on water brings the organization close to drought & livelihood agenda. Parmarth has demonstrated model work on water livelihood linkages by developing micro irrigation model, developing water structure for ensuring water source sustainability. Drought has impacted in the live of the poor families and water crisis further forced poor families to migrate. In this direction, the organization has addressed the water crisis during the drought season and ensured water availability throughout the season through developing and maintaining water sources points. Intervention on drought also consequently relates to education issues of adolescents / girls’ children.
Working with the government is key to the organisation’s function. It mobilizes support of district administration by participating in the various meeting / events like Jal Diwas, etc. Collaboration has led to assured effective implementation of government water programmes and facilitation of inter-sectoral dialogue and information sharing. Another impact of this partnership is convergence and inters departmental coordination and linking of the water issues with health, nutrition, education and other department such as forestry.
In the recent times Parmarth exclusively focusing on community water conservation and protection under MGNREGA, flagship poverty alleviation and job guarantee programme of the government of India at the panchayat level. It also actively monitors the Bundelkhand Package drought-proofing programme.
The organization undertakes research and monitoring of public expenditure on water issues through budget tracking and government policy. It facilitate platform for informed discussion on water related policy with poorest & marginalized perspective. Through its networks and alliance relationship, the organization facilitates interaction among government, NGOs and civil society groups and generates opportunities for poor people towards ensuring water security throughout the year.
The followings information sums up the outcome of the work of the organization:

• A network comprising of 372 women’s groups with 4522 women representatives from rural Bundelkhand.
• Forty nine Water Bodies (Pani Panchayat, Village Water and Sanitation Committees, Jal Saheli) enlists support of 813 functional members.
• Repairing of 1082 Hand pumps ensured drinking water availability to 21625 families.
• Installation of 340 new Hand Pumps provided drinking water to 6756 families.
• Approximately 4122 families were benefitted from restoration of 226 Hand pumps.
• Thirty seven new dug wells were constructed to benefit 1868 families.
• 45 wells were deepened & renovated benefitting 2352 families and addressing their yearlong drinking water need.
• Twenty five new check dams benefited 513 families
• Construction of 20 new ponds benefitted approximately 1800 families.
• Renovations of 31 ponds benefitted 3000 families.
• 28 Roof Water Harvesting Structure constructed benefitting 364 families.

Lenin Raghuvanshi

Historically, Varanasi has always been a place of striking adversities and contradictions. On the one hand, for centuries, it has been one of the most important centers of Hindu culture and civilization which in due course of time turned into the worst kind of reactionary form for the large section of the society, but at the same time Varanasi has also been a battleground for its opposite progressive forces. In 6th BC, Buddha started his struggle from Varanasi against the caste based social structure of hindus which was the main reason for the inequality and exploitation of the large population of Indian society. In later ages Kabir, Raidas and other social and religious reformers followed the tradition of Buddha and challenged the unequal and exploitative structure of hindus based on patriarchal and caste based discriminitations.

 

Despite of long struggles and innumerous sacrifices and sufferings of millions even today the exploitative caste system is still causing miseries and has been the prime source of all sorts of inhuman treatments of lower caste of the Indian society. In such a situation, almost 37 years ago, Mr. Lenin Raghuvanshi born in  an upper caste family in Varanasi . During his study he experienced the vulnerable situation of depressed communities of the society and became impatient to fight it out and decided to hit it hard. After completing his study with distinction as a Physician, he followed the tradition of the greatest Buddha to bring about the human change on the face of the Indian society and refused to live a comfortable life. For last more than 15 years he has been waging a war against the caste system in the area of eastern Uttar Pradesh and going through strenuous struggle against the exploitation and inequality of marginalized communities.

 

Mr. Lenin Raghuvanshi shares his experiences and often says "Buddha was the greatest man the human civilization has ever been produced in the whole history of mankind. Today, even a man of highest rank of imagination can not imagine the social and religious changes he brought about in the whole Asia . He was undoubtedly the first man who introduced humanity in its true sense. Further he asks the question, what was the reason behind the greatness of Buddha? And he himself gives the answer. According to him "People says that he was a genius man. There might be little doubt that he was a man of great intellect and a man of logic but it was not the real reason of his greatness. "Actually", as further he clarifies, "his boldness, his courage and conviction to stand firm in any adverse condition made him great and brought about great changes on the face of Indian society"

 

Mr. Lenin, inspired by the struggle of Buddha, Kabir, Raidas, Jyoti Ba Phule and Dr. Ambedkar, has continued his work even on the cost of his life. Several times he was threatened to his life, faced obstructions and physically and verbally assaulted but he always stood resolute against the all sorts of adversities' and has been successful   to attract the attention of the common people as well as media persons at a great extent. Recently Gwanju human rights committee,City Council of Weimar In Germany recognized his works in the field of human rights and awarded him  human rights awards .

Key Focus on process of testimonial therapy and folk school


Building self-esteem:

 

A human/survivor having self-esteem is creative, happy, and active and has more confidence. Survivors derive confidence about themselves from the way they are treated, mostly by their family/community/therapist/social worker /society at large.

 

Considering that we work with the marginalized survivors, who have experiences of deprivations of various kinds, building self-esteem among these survivors assumes greater importance.

 

Self-esteem refers to the sense of personal worth and ability that is fundamental to an individual's identity. The term self esteem can be explained as an essential quality that one should have, to become a confident and independent person. It is also called as self pride, where the person feels proud of himself and the things he does. A person with high self esteem considers himself/herself capable to achieve whatever he sets out to do. S/He not only knows about his strengths, but also his/her weaknesses. On the other hand, a person with a low self esteem doubts his/her abilities for every step s/he takes, and this attitude may lead to failure in his/her professional as well as personal life. This surely shows the importance of having a high self esteem.  

 

Facilitating Critical thinking:

 

Critical thinking is a process, the goal of which is to make reasonable decisions about what to believe and what to do. Philosophers emphasize the importance of survivor's exposure to causality and logic. Improvement in survivor's cognition allows them to produce new ideas and confront problems by reasoning through them. This 'critical thinking' allow survivors to explore their own concepts, derive conclusions and dispute the reasoning of others.

 

Because we all are continually making decisions, critical thinking is important to us in personal and vocational, as well as societal aspects of our lives.

 

Folk school-Education for life:

 

The challenges marginalized communities today faces are many, and they need to develop skills beyond the mere numerical and literacy skills.

 

Education for life should be one that is able to have an all round development of the marginalized. She/he should try to develop life skills that will make him/her an asset to society and re-build the society based on the principle of social justice. Education for life in the 21st century includes the ability to lead change, think critically, work in teams, create and quickly adapt to new changes - technology, be a self-managed learner, communicate effectively, and understand the needs of the communities in which we live and contribute.

 

Developing Leadership:

The objective is not to teach survivor how to become a leader but to enable them to develop their full potential and teach them basic ethics and values so that they become strong individuals with the capabilities to become a leader. The best way to teach survivors about leadership is by first telling them why individuality and ethics are important. Leaders are the most pro-active people in any group so survivors need to be taught to take the initiative. Discussions with real life examples of leaders and fighting survivors will inspire and motivate survivors.

Helping survivors analyze a situation and take in a lot of different perspectives is also an effective way of teaching how to approach situations differently. Learning from each experience is a very important trait of a leader. Leaders are knowledgeable, so encourage children to read the newspapers and books regularly. Reading can be a great source of inspiration for aspiring leaders.

And lastly, teaching survivors to set goals and high standards. This does not mean we force survivors to achieve the impossible, but enabling them to aim for the best. And more importantly,
empowering them how to get there too!

Kinderernaehrung und RTE Kampagne – VOP

"Voice of People"- eine Menschenorganisation, die sich fuer die Rechte von Kindern in 15 Bezirken des Landes einsetzt, hat eine Kampagne gestartet, um die Zustaende von Bildung und Kinderunterernaehrung aufzuzeigen.

Zur Beurteilung des Schulsystems in Bezug auf Infrastruktur, Budgetverwendung, Bildungsqualitaet und der ausreichenden Menge an Arbeitskraeften hat VOP mitsamt den 14 Basisorganisationen und in Verbindung mit CRY- Child Rights & You eine Gemeinschaftsstudie in 570 Schulen des Landes durchgefuehrt.

 

Die Ergebnisse der 1.Phase der Studie, die 260 Schulen von 15 Bezirken beinhaltet, wurden vom Ausschusskomitee von VOP freigegeben. Dabei verkuendete Dr. Lenin als Koordinator der Kampagne von VOP die Forderungen zur Verbesserung des Bildungssystems: Umsetzung von RTE (Recht auf Bildung) Bestimmungen und die Bildung von NCPCR (National Commission for Protection of Child Rights) im Staat.

 

R.B. Pal, der Generalsekretaer von VOP sagte, dass die Kampagne sich an den Ansaetzen der Sensibilisierung und einem steigendem Bewusstsein als Grundvorschriften von RTE  orientiert; um die Wirkungsweise von Schulen und die wachsenden Forderungen zur Verbesserung der Wirkungsweise von Schulen zu thematisieren, fand die Begutachtung in ueber 220 Doerfern statt.

 

Die Analyse weist auf folgende Fakten der untersuchten Stichprobe hin:

 

Es gibt 39065 Kinder verteilt auf 264 Schulen, was einen Durchschnitt von 147 Kindern pro Schule ausmacht. Das bedeutet, dass nur 51% der Kinder eine staatliche Schule in Anspruch nehmen.

 

Von der Grund- zur Mittelschule verringert sich die Anzahl der Maedchen um 74,34%.

 

Die Regierungsdaten zeigen, dass 2% der Schulkinder koerperlich oder geistig behindert sind, aber die Studie enthuellt, dass der maennliche Anteil 0,35% und der weibliche 0,07% betraegt.

 

In einer Schule in Ambedkarnagar ist ein Lehrer fuer den Unterricht von 520 Kindern verantwortlich, wogegen das Schueler-Lehrer Verhaeltniss in Chandauli 6:1 betraegt.

 

In Sirsianpurwa, einem Dorf bei Bahraich werden 832 Kinder von einem Lehrer unterrichtet.

 

Beim 138 Treffen des Bewillingungsausschusses des Ministeriums fuer Human Resource Developement (HRD) gab die Uttar Pradesh Regierung an, dass 440000Rs fuer Lehrer bereitgestellt wurden; 160000Rs stehen seit dem 15.Maerz noch aus.

 

Die Regierung gab auch an, dass es 18675 1-Lehrer Schulen im Land gibt.

 

Die Regierungsdaten weisen auf eine Schulabbrecherquote nach Beendigung der 7.Klasse von 12% hin, aber die Studie offenbart eine Quote von 48,83%.

 

Das Ok fuer die Bereitstellung eines Lehrnbereichs in Schulen mit einem Satz von 95 Buechern wurde am 4.11.2009 verabschiedet. Die Studie enthuellt, dass 86% der Schulen nicht ueber solche Lehrnecken verfuegen.

 

Die Studie offenbart, dass es in 17% der Schulen keinen Lehrplan gibt, wohingegen 3% der Schulen nicht geantwortet haben.

 

In 92% der Schulen gibt es keine Bestimmungen fuer koerperlich und geistig benachteiligte Kinder.

 

In 33% der Schulen gibt es keinen Schulleiter.

 

27% der kommunalen Bildungsausschuesse sind untaetig, wobei 3% nicht geantwortet haben.

 

In 87% der Schulen gibt es keine Vorschriften fuer einen Spezialunterricht der Kinder.

 

Im Zusammenhang mit RTE bleibt die Frage zur Sicherung der grundlegenden Rechte auf Bildung eines jeden Kindes bestehen.

 

Das Auschusskomitee der Kampagne teilte auch mit, dass die Analysen der Stichproben aus der 2. Phase dem Staat und den zentralen Ebenen, einem UN Berichterstatter fuer Bildung, den Vereinten Nationen und UNESCO uebermittelt werden, um fuer die Sicherung der Bildungsrechte der Kinder zu plaedieren und das Bildungsststem des Staates zu verbessern.

MNREGA fighter Hari Lal killed by Mafia contractor lobby in district Kaushambi of U.P.in India

           MNREGA Fighter and leader of Voice of People (VOP)  Hari Lal of District Kaushambi in U.P. of India has been killed in broad day light at 12.00 Noon in his village Lahna, Block Manjhanpur district Kaushambi on independence day, 15 August 2010 at the instance of the corrupt Gram Pradhan Tirath Lal by the contract killers. Thousands of members of the VOP and other organisation gathered in the village and made militant protest, burnt the houses of the killer.  A heavy contingent of armed police lead by District Magistrate, Superintendent of Police, Circle Officers and SHOs of various police stations entered into the village and let loose the reign of terror over the villagers, women and children. Two FIRs has been lodged against the leaders and members of the VOP including the common villagers.  The leader of VOP Parvez Rizvi has been named in both the FIRs.  One FIR has been lodged u/s 307, 322, 334, 352, 147, 148, 149 IPC and 7 Criminal Amendment Act  in which 5 persons have been named and the second FIR has been lodged u/s 353, 336, 506, 427, 352, 436, 392, 147, 148, 149 IPC and 7 Criminal Amendment Act. Both the FIRs have been lodged by police andin both the FIRs VOP leader Parvez Rizvi has been named. 
            Hari Lal ,A dalit was active in organising the labourers andthe marginalised people against the corruption in MNREGA in all 3 blocks namely Manjhanpur, Kaushambi and Sarsawan of district Kaushambi and on several occasions, he alongwith other leaders lead thousands of labourers to the district Head quarters against the loot of contractors, gram pradhan and officers in the implementation of welfare scheme. At one occasion, DM, Kaushambi was compelled to come to the Rally of the labourers and promise to distribute the unpaid wages and on many occasions, BDOs were gheraod for hours and compelled to distribute the wages. Hari Lal was also active with the other leaders of VOP to build a strong trade union of Bidi Workers under the banner of "Kaushambi Bidi Mazdoor Manch" and on 01.07.2010 about 4000 Bidi Workers and their supporters held a massive rally in district head quarter Manjhanpur under the leadership of Parvez Rizvi, Hari Lal and others.
            The constant fight of VOP and Hari Lal had infuriated the Mafia elements in which the Kaushambi police played an active role. It is to be noted that the Kaushambi Police was informed in advance that the life of Hari Lal is in danger and the Mafia elements had threatened to kill him but the Kaushambi Police kept misterious silent and after the brutal murter of Hari Lal, in the garb of maintaining law and order, the Kaushambi police is harassing and arresting the VOP leaders and the common villagers.

Please intervene with Government of UP and India for appropriate action.
